RESUMO

O presente trabalho faz uma retrospectiva da evoluo normativa do Direito gua, desde seu reconhecimento "indireto" como direito fundamental nas normas internacionais, at o papel de destaque que assumiu no final do sculo passado. Analisa-se ainda o conjunto normativo que trata da proteo dos recursos hdricos nos ordenamentos de Portugal e do Brasil. Tambm so discutidas as aes necessrias para a efetivao desse direito fundamental.

ABSTRACT

This paper looks back on the normative evolution of the Right to Water, from its "indirect" recognition as a fundamental right in international standards, to the prominent role it assumed at the end of the last century. It also analyzes the normative set that deals with the protection of water resources in the regulations of Portugal and Brazil. The actions necessary for the realization of this fundamental right are also discussed.
